CITI PRESTIGE® CARD BENEFIT TERMS AND CONDITIONS

Your Citi Prestige® Card Program includes benefits provided by Citi® or certain third party service providers ("Service Provider"). With the Citi Prestige Card you are eligible for benefits provided through the MasterCard® World Elite® program. In order to make use of these benefits you must make the qualifying purchase with your Citi Prestige Card and your card account must be open and current.

We have the right to add, modify, or delete any Citi Prestige Card benefit, service, or feature at our discretion, at any time. Citi is not responsible for the products or services offered by other companies.


CITI THANKYOU® REWARDS/CITI PRESTIGE® CARD

Citi ThankYou® Rewards is offered to certain Cardmembers ("you") at the sole discretion of Citibank, N.A. ("we"), the issuer of your card account ("Card Account"). ThankYou® Rewards or any portion thereof may be revised or terminated with 30 days prior written notice. Any revisions may affect your ability to use the ThankYou Points you have already accumulated. If ThankYou Rewards is terminated, you will only have 90 days from ThankYou Rewards termination date to redeem all your accumulated ThankYou® points ("ThankYou Points"). Rewards offered by ThankYou Rewards and the ThankYou Point levels required for specific rewards are subject to change without notice.

Unless you are participating in a limited-time offer, you will earn 3 ThankYou Points for every dollar you spend on purchases at airlines, hotels and travel agencies' and you will earn 2 ThankYou Points for every dollar you spend on purchases at restaurants and select entertainment merchants, including sports promoters, theatrical promoters, movie theaters, amusement parks, tourist attractions, record stores and video rental stores. You will earn 1 ThankYou Point for every dollar you spend on all other purchases. Restaurants are classified as dining establishments that primarily prepare food and drinks for immediate consumption by consumers, either on the merchant's premises or packaged for takeout, and include bars, cocktail lounges, discotheques, nightclubs, taverns and fast food restaurants.

Sports promoters are classified as merchants that operate and promote live sporting events (professional or semi-professional), and may also include sports stadiums. Theatrical promoters are classified as merchants that operate live theatrical productions or concerts, and include ticketing agencies. Movie theaters are classified as establishments that sell tickets and refreshments for movie productions. Amusement parks (including zoos, circuses and aquariums) are classified as establishments that operate parks or carnivals and offer mechanical rides and games and/or live animal shows. Tourist attractions and museums (including art galleries) are classified as establishments that operate attractions and exhibits for tourists. Record stores are classified as establishments that sell CDs and related items, including online record stores. Video rental stores are classified as merchants that rent DVDs and/or games and related equipment for consumer use, including online video rentals. Airlines are classified as merchants that provide air travel. Hotels are classified as merchants that provide sleeping or meeting room accommodations, and may include goods and services that are on a bill for these accommodations by a hotel, motel or inn. Travel agencies are classified as merchants that provide travel information and booking services, and include travel aggregators and tour operators.

Limited-time promotional offers do not apply to personal banking transactions you make using your card. So you will earn only 1 point per dollar spent on these transactions.

We do not determine whether merchants appropriately identify all transactions you make on your Card Account, but we do reserve the right to determine which purchases qualify for ThankYou Points. Your ThankYou Points will not expire unless we terminate ThankYou Rewards.

For those with a Citi® banking relationship, a relationship bonus will be a fixed percentage based on a percentage of purchases during that membership year (the membership year begins that date you became a Citi Prestige Cardmember). You will earn a relationship bonus based on your Citigold, Citi Private Bank, Global Client or employee status as follows:

You may earn ThankYou Points as long as your Card Account is open and current. If your Card Account is closed, you will not be able to earn ThankYou Points and you will lose any accumulated ThankYou Points that have not been transferred to your ThankYou Member Account. Balance transfers, cash advances, convenience checks, returned purchases, disputed or unauthorized purchases/fraudulent transactions, finance charges, Card Account fees, and fees for services and programs you elect to receive through us do not earn ThankYou Points unless otherwise specified.

If you do not already have a ThankYou Rewards Member Account ("ThankYou Member Account"), one will be set up for you. ThankYou Points earned from purchases post to your Card Account at the close of each billing cycle, and at that time we will transfer the ThankYou Points you earned to your ThankYou Member Account. However, ThankYou Flight Points are not transferred to your ThankYou Member Account unless we transfer, or have previously transferred, an equal or greater number of ThankYou Points earned from purchases. ThankYou Points, including ThankYou Flight Points are not eligible for redemption until they are transferred to your ThankYou Member Account. This transfer may take up to four business days. $250 AIR TRAVEL CREDIT

Purchases made by the Primary cardmember and Authorized Users on the Card Account are eligible for this statement credit. Please allow 1-2 billing cycles after the qualifying incidental air travel fee is charged to your Card Account for statement credit(s) to be posted to the account. This statement credit is an annual benefit available for purchases appearing on your billing statements from December through the following December. Pending transactions that do not post in your December billing cycle will count towards the next year's Air Travel Credit.

  • Airline Fees are defined as purchases made with airlines including Air fares, baggage fees, lounge access and some in-flight purchases. Please allow 1-2 billing cycles after the qualifying air travel expense is charged to your Card Account for statement credit(s) to be posted to the account.

INTERNATIONAL COMPLIMENTARY NIGHT HOTELS AND RESORTS PROGRAM TERMS AND CONDITIONS

You will enjoy a complimentary fourth night with no black-out dates, when you book four consecutive nights at any hotel booked by a personal travel advisor designated by MasterCard (the "designated travel advisor" is Carlson Wagonlit Travel). Bookings made through other methods such as, travel agents, websites or directly with a hotel will not qualify.


To receive your complimentary night (via a statement credit) you must:



  • Make a reservation for a minimum, consecutive four-night stay by contacting the Citi Prestige Concierge, to book directly with a designated travel advisor
  • Fully pay for your stay with a Citi Prestige Card

Receive one complimentary night (room rate for the fourth night and applicable taxes only) for any consecutive four-night hotel stay booked directly with a MasterCard designated travel advisor. Hotel imposed fees and incidental guest charges are the Cardmember's responsibility. The value of the complimentary night will be the actual rate, as provided by the designated travel advisor, on that fourth night of the reservation, even if the rate is different from the rate on other nights. Cardmember will be charged the total cost of the stay at checkout and will receive a credit to the credit card statement for the cost of the fourth night (and the applicable taxes). If the cardmember books a special "pre-paid" rate this may require upfront payment in full, at time of booking. Payment in full is defined as pre-payment for the total of all four consecutive nights. Only one complimentary night is eligible per each stay. A stay is consecutive nights booked and stayed on one reservation and does not include back-to back stays. Back-to back stays are stays at the same hotel booked on two reservations (as an example, you book four nights at a hotel on one reservation for Monday, Tuesday, Wednesday and Thursday and book another four nights on another reservation for Friday, Saturday, Sunday and Monday. In this situation, you would only be eligible for one complimentary night for the 8 night stay). Rates provided will be equal to or lower than the lowest publicly-available fare at the hotel's official website. The benefit can only be used by the primary account cardholder.


Statement Credit for Hotel Program

Fulfillment

All statement credits will be reflected on the Citi Prestige card statement as being a result of the Program and will appear within two billing periods following the month in which travel was completed; or in the case of promotional "pre-paid" that are paid in full as described above, rates the credit will be reflected within two billing periods following the date of payment in full of the "pre-paid" rate. Foreign exchange conversion rates may fluctuate resulting in slight differences in amount credited.


Cancellations and Reversals

All cancellations must be done through the designated travel advisor. If the reservation is cancelled, any statement credit relative to the offer will be reversed, based upon the eligibility and satisfaction of the terms of the offer. Citi and MasterCard reserve the right to reverse a statement credit including, and without limitation, any refunds, returns, disputes, adjustments or fraudulent card activity.


Merchant and Merchants Offers

Neither Citi nor MasterCard will be liable for any loss or damage incurred as a result of any interaction between a Cardmember and a Merchant (a "Merchant" is a travel supplier) with respect to the Program. Except as set forth herein, all matters, including but not limited to delivery of goods and services, returns, and warranties are solely and strictly between Cardmember and the applicable Merchants, subject to applicable law. Cardmember acknowledges that Citi and MasterCard do not endorse or warrant the Merchants that are accessible through the Program, nor the Offers that they provide.


Cardmember Responsibilities

By consenting to the Terms, you agree that: (i) you represent only yourself here and no other person; (ii) that you are of the legal age of majority in order to enter into contracts or if you are entering into these Terms for a small business you are able to bind such entity; and (iii) you will provide accurate information to Citi and MasterCard, including, but not limited to, information required to register for the Program; and (iv) you will not use the Program for any purpose that is unlawful or prohibited by the Terms.

Acceptance of Terms and Conditions:

This Citi Prestige program (the "Program") entails hotel and airline benefits to Citi Prestige Cardmembers. Under the Program Cardmember has access to benefits from participating hotels and airlines. Please read these Terms of and Conditions of each Benefit carefully before using the benefit. By using this Program, Cardmember agrees to these Terms of Use and any operating rules and policies that may be published by Citi and/or MasterCard International Incorporated ("MasterCard"). MasterCard is a service provider for the Program ("Service Provider"). Terms of Use may be amended from time to time (the "Terms"). MasterCard may change these Terms at any time without notice, and any such changes will be effective when sent to the Cardmember. By using the program Cardmember acknowledges that Cardmember has read, understood, and agreed to be bound by all of the terms and to comply with all applicable laws and regulations. Cardmember should retain a copy of this agreement for their records.



For the purposes of this Program, the following conditions apply: (i) all bookings and cancellations for travel must be made through the Travel Advisor; (ii) the booking must be made and fully paid for with a Citi Prestige Card; (ii) must be at least 18 years of age; (iii) must be a legal resident of the country in which the card was issued; (iv) must satisfy all terms of the offer to be eligible for the offer; (v) the transaction must be completed with a Citi Prestige Card. Additional terms, conditions and exclusions apply. For any questions or issues about whether a Citi Prestige Card is eligible or regarding Program benefits, Cardmember must contact Customer Service number located on the back of the card. GLOBAL ENTRY APPLICATION FEE CREDIT

Global Entry Membership allows international travelers expedited entry upon arrival in United States, by using automated kiosks when entering the United States. Once approved, Global Entry members can use automated kiosks in most major U.S. airports, rather than having to go through the traditional arrival process. There is a $100 application fee payable to US Customs and Border Protection (CBP) which administers the program. As a benefit of the Citi Prestige Card, Citi will provide one statement credit for this $100 application fee, once the fee is charged to the account. The $100 application fee credit will reset once every 5 years.



GLOBAL ENTRY PROGRAM TERMS AND CONDITIONS

TERMS AND CONDITIONS (Per CPB):

  1. To qualify you must be a U.S. citizen, lawful permanent residents of the U.S., and citizens of certain other countries are eligible for Global Entry membership provided that they:
    • *Have never been convicted of a criminal offense in any country
    • *Have never been found in violation of customs, immigration or agricultural laws
    • *Do not provide false or incomplete information on their application
    • *Are not the subject of an investigation by any Federal, State, or local law enforcement agency.
  2. Once you submit an application online, your application will be reviewed by CBP. If you pass the initial checks, you will be asked to schedule an interview at one of the Global Entry Enrollment Centers. At that interview a CBP officer will determine your eligibility, take your photo, and collect biometric information (e.g. fingerprints).
  3. Applicants must have a valid machine readable passport and one other form of government issued identification such as a driver's license or ID card. If you are a permanent resident of the U.S. you must provide your machine readable permanent resident card.
  4. Children under the age of 18 will require consent by a parent or legal guardian.

MASTERCARD AIRPORT CONCIERGETM TERMS AND CONDITIONS

This benefit is brought to Citi Prestige Cardmembers by MasterCard International but the Service Provider is Global Airport Concierge Ltd.


MasterCard Airport ConciergeTM Service is provided by Global Airport Concierge Ltd. In the case of making any airport concierge service ("Meet & Greet") bookings utilizing MasterCard Airport Concierge provided by Global Airport Concierge ("GAC"), it is the Citi Prestige cardmember's responsibility to provide all the required and correct information. Any lack or delay of the information can affect the service and neither MasterCard International Incorporated ("MasterCard") nor GAC will be held responsible for any such event. It is the Citi Prestige cardmember's responsibility to choose and book a start time that allows sufficient time for the service to take place or the formalities to be completed in good time. There is no charge for any cancellations made more than 48 hours in advance of the service. For any cancellations made within 48 hours prior to the scheduled service, there is a 100% charge equivalent to full invoice and no right to refund. There is no charge for any amendments to the services made more than 48 hours in advance of the service. For any amendment made less than 48 hours in advance of the service, there will be a change fee imposed, which varies depending on the airport. Airside access at some airports may be subject to possible security restrictions. Infants up to 12 months will not be charged and between 12 and 36 months will be charged at 50%. Standard service times are typically 3 hours. Additional fees may apply for service-times of more than 3 hours. This does not apply to cases when flights are unexpectedly delayed. Additional fees may apply after the initial booking due to changes/cancellations made within 48 hours of travel, extra services added or additional passengers added at the airport. The primary cardmember will receive 3 complimentary rounds of golf through the Citi Prestige® Golf Portal (provided by GolfSwitch, Inc.) each calendar year, subject to the terms and conditions of the Program. Complimentary rounds are for the primary cardmember only. The Citi Prestige card must be used to reserve the rounds, and if the round is eligible for the complimentary offer, the cardmember will not be billed. After the 3 free rounds of golf are used, the cardmember will need to use their Citi Prestige card to book and pay for additional rounds. Cardmember must book at least 3 days in advance of tee date.



TEE TIME BOOKING AND AUTHORIZATION AGREEMENT

By accepting this Agreement you


(1) authorize GolfSwitch to transmit your name, address, E-mail address and credit card information to the golf course at which you make such reservation and to the Website Booking Agent and


(2) acknowledge that the Website Booking Agent's operators may use your credit card to guarantee the reservation and/or charge the greens fee in advance.



The golf course you have selected requires advance notice before day of play for any cancellation which you may furnish by either following the cancellation policy on the GolfSwitch site or by contacting the Citi Prestige Concierge directly. If you do not cancel your reservation in accordance with the cancellation policy, you may be charged the entire greens fee for all rounds reserved.


Although GolfSwitch is using its most reasonable effort to provide an internet reservation system for customers desiring to reserve rounds at golf courses participating in its network, you understand that GolfSwitch is providing its reservation service "as is" without making any warranties of any kind, including any express warranties and the implied warranties of merchantability and fitness for a particular purpose, except as required by law. Golf Switch's maximum liability for any damages that you may suffer or that may result from your use of the reservation system will not exceed the aggregate booking fee paid for the reservation owing rise to the damages. In no event will GolfSwitch or any of its Suppliers be liable for any consequential, incidental or any such damages or for lost profits of any kind, even if apprised of the possibility of any such damages.

  1. All offers are subject to change and tee-time availability. Cardmembers must book golf with their Citi Prestige card. Primary Citi Prestige cardmembers are entitled to complimentary green fees at 6 participating golf courses (2 courses in Singapore, 2 courses in Malaysia and 2 courses in China).
  2. Primary Citi Prestige cardmembers are entitled to book and play for a maximum of three (3) times a year at each of these 6 courses.
  3. All payments for cardmember(s) and guest(s) must be made upon booking and charged to their Citi Prestige card
  4. Minimum golfer requirement per flight applies as required by the respective golf clubs.
  5. Weekday bookings must be made at least 4 days in advance
  6. Weekend bookings must be made at least 8 days in advance.
  7. Cardmembers cannot book more than 14 days in advance.
  8. Primary Citi Prestige cardmembers are not required to pay green fees. However, cardmember is required to pay for buggy fees, caddy fees, taxes and all other ancillary charges which the participating golf club may specify and charge from time to time.
  9. Guests of Primary Citi Prestige cardmembers are required to pay green fees, buggy fees, caddy fees, taxes and other ancillary charges at the participating golf club rates. There is no limit to the number of guests but bookings are subject to availability. Rates are subject to change without notice.
  10. Cardmembers cannot book for the next golf game until the current booked game has been played. All bookings are subject to availability.
  11. Cardmember(s) and guest(s) must have valid handicap and the club may require golfers to produce their Handicap card upon registration.
  12. Cardmember(s) will not be granted access rights to the participating clubs without booking through Citi Prestige Concierge. Golf clubs will not entertain any correspondence / enquiries and / or attempts for bookings directly from cardmember.
  13. The program cannot be used by cardmember(s) or their guests in conjunction with any other promotional golf offers.
  14. Citi and its partners, affiliates and contractors does not assume liability and cardmember(s) shall not make any claim whatsoever for:
    • Injury or bodily harm
    • Loss or damage to property, howsoever caused, arising from or in connection with the Citi Prestige Complimentary Green Fees program
  15. Citi reserves the right to replace the participating golf clubs under this Program, without prior notice to cardmembers.
  16. Amendment and cancellation fees apply after the golf booking has been confirmed. Cardmembers will be quoted the cancellation fee (plus any applicable taxes on that fee) at time of booking and with the confirmation of the booking. In addition, the specific cancellation and amendment fees for the Program are listed at citi.com/citiprestige in the International Golf Program Terms and Conditions section, or by calling your Concierge. For certain golf courses these fees can be as much as a round a golf at the elite course and also subject to additional Taxes. Change of dates within the cancellation period is considered a cancellation and penalty fees will apply
  17. The Golf program allows only access to the golf facility only. Cardmembers and/ or their guests will not have access to the other facilities at the golf club(s).

PRIORITY PASS SELECT LOUNGE ACCESS TERMS AND CONDITIONS

The Service Provider is Priority Pass


  1. Primary and Authorized users are granted complimentary access to the Priority Pass lounges and allowed a maximum of up to two guests or immediate family members (spouse, domestic partner and/or children under 18 years of age). Any additional guests will be charged a $27 per guest, per visit charge.
  2. The conditions of use on the Priority Pass website prevail over any other terms and conditions provided to the cardholder in relation to the use of the Priority Pass Card.
  3. The Priority Pass card is not transferable and is only valid up to its date of expiry and when it has been signed by the cardholder. The card may not be used by any person other than the named cardholder and only one Priority Pass card may be used for each lounge visit.
  4. The Priority Pass card is not a payment card nor is it proof of creditworthiness and attempts to use it as such could constitute fraud.
  5. Admittance to a lounge is conditional upon presentation of one valid Priority Pass card per person only (some restrictions may apply to Priority Pass Select cardholders and Priority Pass cardholders in the U.S. that receive their membership through a U.S. financial institution). Citi Prestige Cards will not be accepted as substitutes for the Priority Pass card.
  6. Lounge visits are subject to a $27 per person per visit charge. Priority Pass may amend the lounge visit charges at any time on providing 30 days' notice in advance of such change. Where the cardholder receives the Priority Pass card through third party card issuer, any changes in lounge visit charges shall be notified to Citi, who is responsible for advising the cardholder. The cardholder agrees that the Priority Pass Group of companies is not responsible for any disputes that may occur between the cardholder and Citi nor for any loss incurred by the cardholder relating to any lounge visit charges debited by Citi.
  7. In the event that the cardholder does not accept any change in the lounge visit charges, the cardholder shall have the right to terminate their membership on providing notice in writing directly to Citi who will be responsible for informing Priority Pass and liable for any costs the cardholder incurs as a result of its failure to inform Priority Pass of such termination.
  8. When presenting the Priority Pass card on entering the lounge, lounge staff will either electronically scan or take an imprint of the card and issue a 'Record of Visit' voucher or receipt to the cardholder or make a log entry. The cardholder must sign the 'Record of Visit' voucher or receipt, or sign the electronic reader (as applicable), which will also reflect the exact number of accompanying guests, if any, but does not show any per person per visit charge. The charge per visit for the cardholder, where relevant, and that for any guests will be based on the 'Record of Visit' voucher/receipt/log submitted by the lounge operator.
  9. The lounge staff, will where appropriate, make a voucher imprint/log entry of the Priority Pass card, and the cardholder is responsible for ensuring the 'Record of Visit' voucher/receipt/log correctly reflects their own usage and that of any guests at the time of using the lounge. Where applicable, the cardholder is responsible for retaining the 'Cardholder's' copy of the 'Record of Visit' voucher or receipt presented to them at the lounge.
  10. Access to the lounges for children and the fees for such visits varies across the lounges and the cardholder is advised to check the individual lounge description before travelling.
  11. All participating lounges are owned and operated by third party organizations. The cardholder and accompanying guests must abide by the rules and policies of each participating lounge. The cardholder accepts that the Priority Pass group of companies has no control over the lounge operator's decision whether to admit any cardholder, the number of people allowed in any lounge at any time, facilities offered, the opening/closing times, the length of time which cardholders may spend in the lounge and any charges payable for extended lounge visits or the personnel employed by the lounges. The administrators of Priority Pass will use reasonable endeavours to ensure the benefits and facilities are available as advertised, but the cardholder accepts that the Priority Pass group of companies does not warrant nor guarantee in any way that all or any of the benefits and facilities will be available at the time of the cardholder's visit.
  12. The cardholder further accepts that the Priority Pass group of companies is not liable for any loss to the cardholder, or any accompanying guests, arising from the provision or non-provision (whether in whole or in part) of any of the advertised benefits and facilities.
  13. Participating lounges have no obligation to announce flights and the cardholder accepts that the Priority Pass group of companies shall not be held liable for any direct or indirect loss resulting out of any cardholder and/or accompanying guests failing to board their flight(s). It is the cardholder's responsibility to check the relevant entry requirements for any country being visited and to have the correct travel documentation for the journey.
  14. The provision of free alcoholic drinks (where local law permits) is at the discretion of each lounge operator and in some cases may be limited or unavailable. In such cases the cardholder is responsible for paying any charges for additional consumption direct to the lounge staff. (See individual lounge descriptions for details.)
  15. Telephone and Wi-Fi facilities (where available) vary from lounge to lounge and are provided at the lounge operator's discretion. Free usage of telephone facilities is normally limited to local calls only. Charges for any other lounge facilities are at the discretion of each lounge operator and the cardholder is responsible for paying these direct to the lounge staff.
  16. Admittance to lounges is strictly subject to cardholders and any guests being in possession of a valid flight ticket and travel documents for the same day of travel. Airline, airport and other travel industry employees traveling on reduced-rate tickets may not be eligible for access. Outside the US, flight tickets must be accompanied by a valid boarding pass for a departing flight, i.e. outbound passengers only. Please note some lounges in Europe are located within designated Schengen areas of the airport which means that access is only provided to these lounges if cardholders are traveling between Schengen countries (an up to date list of Schengen countries is detailed at http://ec.europa.eu/dgs/home-affairs/what-we-do/policies/borders-and visas/schengen/index_en.htm.)
  17. Admittance to lounges is subject to cardholders and any guests (including children) behaving and dressing in accordance with the relevant lounge terms and conditions and any person not complying with such terms and conditions may be asked to vacate the lounge facilities. The Priority Pass group of companies is not liable for any loss suffered by the cardholder and any guests where a lounge operator has refused admission because the cardholder and/or guests have not complied with these conditions.
  18. To the fullest extent allowed by law, the Priority Pass group of companies accepts no responsibility for the actions of the cardholder when using any participating lounge and shall not be responsible for any personal belongings brought into a lounge by cardholders.
  19. Lost, stolen or damaged Priority Pass cards are to be notified immediately to (i) the Priority Pass office from which the card was issued or (ii) to Citi, who shall be responsible for providing a replacement card. A charge may be levied for any replacement card.
  20. In the event of the cardholder cancelling their Citi Prestige Card with the card issuer, the Priority Pass card shall be invalid effective from the cancellation date or the expiry date (as applicable) of their Citi Prestige card. Any lounge visits made by a cardholder using an invalid card, including any guests, shall be charged to the cardholder.
  21. All disputes must be settled directly with the lounge in question and the Priority Pass group of companies shall not be liable for any costs, damages, losses or expenses related to such disputes.
  22. The Priority Pass group of companies reserves the right at any time in its sole discretion and without notice to revoke membership to Priority Pass or to terminate the Priority Pass programme. Where applicable a proportional refund of the annual fee/enrollment fee (whichever is applicable) will be made provided revocation has not been made because of fraud or misuse by the cardholder.
  23. The cardholder agrees that s/he will defend and indemnify the Priority Pass group of companies, its directors, officers, employees and agents (collectively 'the indemnified parties') against and hold each indemnified party harmless from all liabilities, damages, losses, claims, suits, judgments, costs and expenses (including reasonable legal fees) for injury to or death of any person or damage to or destruction of any property arising out of the use of any lounge by the cardholder or any other person accompanying the cardholder, except that such indemnification shall not extend to acts of gross negligence or willful misconduct by the indemnified parties.
  24. Priority Pass makes no representations as to any income, use, excise or other tax liability of cardholders as a result of their Priority Pass membership. Cardholders are advised to check with their accountant or tax adviser for further information. The cardholder is solely responsible for any tax liability as a result of Priority Pass membership.
  25. By using a Priority Pass card, the cardholder consents to any personal data being used in accordance with the Priority Pass privacy policy available at www.prioritypass.com or available on written request to Priority Pass at Cutlers Exchange, 123 Houndsditch, London EC3A 7BU, UK.
  26. The Priority Pass group of companies is constantly trying to improve the services it provides to cardholders. Any cardholder with concerns or complaints may contact Priority Pass. Priority Pass may occasionally monitor telephone calls from cardholders to maintain and enhance its services. All complaints relating to any lounge visit should be made within six months of the relevant lounge visit.
  27. Priority Pass reserves the right at all times to make any changes to these Conditions of Use.
  28. To the extent permissible by local law or regulation these Conditions of Use shall be governed by and construed in accordance with English law and Priority Pass and the cardholder submit to the non-exclusive jurisdiction of English courts to resolve any disputes that arise out of them.
  29. Any provision of these Conditions of Use declared void or unenforceable by any competent authority or court shall, to the extent of such invalidity or unenforceability, be deemed severable and shall not affect the other provisions of these Conditions of Use.
  30. If there is any conflict in meaning between the English language version of these Conditions of Use and any version or translation of these Conditions of Use, the English language version shall prevail.

CITI PRESTIGE® CONCIERGE SERVICE PROVIDED BY TEN LIFESTYLE LTD.

Background


Ten is owned, managed and operated by TEN Lifestyle Management Limited, a lifestyle management company registered in England and Wales (registration number 4688658) whose registered address is: 4th Floor, 30 Market Place, London, W1W 8AP


The concierge service is provided primarily through the arrangement of specialist services using Partnered Suppliers (see below for definition) or suitable service professionals. The range of services offered by concierge includes destination information, entertainment (restaurant bookings, tickets, private members' clubs, event management, catering, guest lists) and retail.


Partnered Suppliers are fully audited by TEN Lifestyle Management Ltd and accept TEN Lifestyle Management Ltd's terms and conditions of business. Citi Prestige cardholders are eligible for the concierge service.


The eligible customer is hereafter referred to as 'you' or 'your' for the purposes of this Agreement.


  1. Obligations of Ten
    1. 1.1. Ten agrees to use all reasonable endeavours to introduce you to suitable service professionals who are best suited to meet your needs. For certain jobs, Ten may undertake to manage the job and liaise with the service professionals on your behalf.
    2. 1.2. Ten agrees to use all reasonable efforts to ensure that when you use the service, you do not pay more than the local market rate or the recommended retail price for any goods or services concerned. This is referred to as the Ten pricing principle.
    3. 1.3. Ten agrees to update you as soon as is reasonably practical in respect of any fundamental changes within Ten, including, amongst other things, systems of work, pricing principles, subscription fees and additional charges.
    4. 1.4. In the event of any complaint about the Ten service, you should raise the issue directly with Ten, who undertake to look into the issue within 2 working days of receipt of notification of the complaint and report back to you as soon as reasonably practical. This does not in any way affect your statutory rights.

  2. Partnered Suppliers (PS's)
    1. 2.1. For concierge requests, where possible Ten Lifestyle will introduce you to a service professional that is a Partnered Supplier (PS). For other benefits associated with the Citi Prestige card, Ten Lifestyle will introduce you to a Citi or MasterCard vendor.
    2. 2.2. Ten Lifestyle will use all reasonable endeavours to ensure that the PS's are reputable companies offering quality and value to their customers.
    3. 2.3. The contract for work to be carried out by the PS is between you and the PS. Ten Lifestyle is not party to that contract.
    4. 2.4. Where communication is directly between you and the PS, it is the responsibility of the PS to communicate its terms and conditions of business, method of work and prices to you. Where Ten is communicating all the information about the PS and arranging things on your behalf, Ten will communicate all relevant terms and conditions and prices.

  3. Other service professionals
    1. 3.1. In the event that Ten Lifestyle does not have a PS to carry out your requested jobs, Ten will take reasonable steps to find another service professional to do so. Ten cannot guarantee such a service professional in any way whatsoever.

  4. Your obligations
    1. 4.1. The service will commence from the time the Partner Organisation funding the service so agrees in the contract with Ten.
    2. 4.2. You agree to use best endeavours to provide true, accurate, current and complete information when providing details to Ten.
    3. 4.3. You agree to notify Ten as soon as practical of any changes to the information provided, when appropriate.
    4. 4.4. You agree not to impersonate any other person or entity or to use a false name you are not authorised to use.
    5. 4.5. You agree to take responsibility for ensuring that any individual covered under the membership (i.e. other adults sharing your Citi Prestige® Cardmembership) complies with the terms of this Agreement and that any non-compliance by the individual will be deemed to be a breach of the Agreement by you.

  5. Charges and payment
    1. 5.1. You agree to pay all charges reasonably levied by Partnered Suppliers, as notified to you at the time of booking. You will be notified of any changes to pricing as laid out in clause 2.4.
    2. 5.2. Additional charges may be incurred from time to time, for example if Ten's lifestyle manager has to leave the office to run an errand on your behalf. These charges will always be agreed in advance with you.
    3. 5.3. From time to time, Ten may also charge for specific, complex tasks, presented to you as a 'package'. This will apply where there is no supplier or where Ten can provide a more competitive service than existing suppliers. These packages will be defined and agreed with you in advance of any additional payment being agreed.
    4. 5.4. Ten may earn commission from PS's as a result of introducing you to a PS. In most cases, the commission is calculated as a percentage of the value of the work carried out by the PS on your behalf. This percentage will vary on, amongst other things, the quantity, quality and nature of the work undertaken by the PS for the Ten membership as a whole. In any event, the level of commission will not override Ten's obligation under section 2.2.

  6. Confidentiality
    1. 6.1. All private information matters or issues that you disclose to Ten or employees or officers are confidential. Neither will disclose information about you to third parties other than for the purposes of this Agreement.
    2. 6.2. TEN Lifestyle Management is regulated by the Data Protection Act 1998 (registration number Z7761476). For details please see http://www.legislation.gov.uk/ukpga/1998/29/contents.
    3. 6.3. Recording of phone calls. Your calls may be monitored or recorded for training and quality purposes.

  7. Liability
    1. 7.1. When you instruct a PS, your contract for that PS's services is with the PS not Ten. Ten is not responsible for the actions of the PS.
    2. 7.2. Subject fully to its obligations under clauses 2.1, 2.2, 2.3, 3.1 and 3.2 above, Ten accepts no responsibility for any loss, liability or cost incurred by you as a result of any act or omission by the PS.
    3. 7.3. Subject fully to its obligations under clauses 2.1 and 2.2 above, Ten Lifestyle accepts no responsibility for any loss liability or cost incurred by you as a result of any act or omission by any other service professional who is not a PS.
    4. 7.4. Ten makes no warranty that the use of the service will be uninterrupted, timely or error free.
    5. 7.5. Ten accepts no responsibility for any act or omission beyond its reasonable control.

  8. Termination
    1. 8.1. Ten reserves the right to withdraw or suspend the service in the event of any dispute between you and Ten, Partnered Suppliers or any other service professionals

  9. Governing Law and Jurisdiction
    1. 9.1. This agreement is governed by and shall be construed in accordance with English Law.
    2. 9.2. The courts of England have exclusive jurisdiction to hear and decide any suit action or proceedings and to settle any disputes which may arise out of or in connection with this Agreement and for these purposes each party irrevocably submits to the jurisdiction of the courts of England (save in the cases of members based in Scotland in whose case the Scottish courts shall also have jurisdiction).
